Data of a personal nature is all information about an identified and identifiable physical person.   • Participation in the studies and surveys carried out by JANÉ in order to examine the state of the market and the rating of its products.

  • Interaction with the Web Site and with JANÉ on social media: via the use you make of the Web Site when browsing the site, and through the interaction you may have with JANÉ via the corporate profiles on various social media platforms.

A) Right to access

You have the right to know if JANÉ is treating your personal data or not, and in the event, the right to know what data is being treated.

This consists in your right to modify your data if it is inaccurate or incomplete. Whenever you request rectification of your personal data, you must indicate what data you wish to modify and provide suitable accreditation.

C) Right to objection

You can object at any moment to our handling of your data within the envisaged legal circumstances. However, there are certain conditions under which it is legally established that you cannot exercise this right, for example, when the legal basis for the handling of your personal data is the execution of a contract or compliance with a legal obligation on our part. With the exception of these circumstances, you may object at any time, for reasons related to your specific situation, to the personal data you are concerned about being the object of processing by us. This is a right that you can clearly exercise when the processing of data is based on our legitimate interests as a company. In the event that you exercise this right, JANÉ will desist from handling your personal data, being able to make the data anonymous or through elimination, except when we can demonstrate legal reasons for the processing which take precedence over your interests, rights and liberties, such as, for example, their conservation during a prudential period for the creation, exercise or defence against complaints deriving from the relationship existing between JANÉ and the user.

D) Right to suppression

This right allows the cancellation of your personal data. This does not mean that your data will be completely eliminated, but that your data will be saved but blocked in such a way that impedes handling, without prejudice to the data being made available to public administrations, judges and courts, in order to address possible responsibilities arising through the processing during the prescription period. Once this period has lapsed, your data will be duly made anonymous or eliminated. You are reminded that while there are contractual obligations pending for either party, we will not be able to suppress your personal data. 

E) Right to data portability

You have the right to receive and/or transfer to another data handler that is not JANÉ any personal data that is yours and you have provided us with. It is only possible to exercise this right when the processing is based on the execution of a contract or on your consent, and the processing is made via automated means.

F) Right to limitation of processing

This right allows you to ask us to suspend the processing of your data when: 

  • You have contested the accuracy of the data, while JANÉ is verifying the accuracy.
  • You have exercised your right to objection regarding the processing of your data, while checks are made to determine whether the legitimate interests of JANÉ take preference over yours as the interested party. 

Likewise, this right allows you to ask JANÉ to to save your personal data when: 

  • The processing of data would be illicit and as the interested party you oppose the suppression of your data, and instead request a limitation on use.
  • JANÉ no longer requires your personal data for the purposes of processing, but needs them for the creation, exercise or defence against complaints.

2) What is the legal basis for the handling of your data?

This column explains the legal basis or justification that allows us to legally handle your personal data. Data protection regulations state that in order for us to handle your data there is a legal basis or justification which legitimises the handling. The legal basis for the handling of your data is the express consent provided to JANÉ to inform you regarding the evolution and maintenance of your product.

7. ANALYSIS; SEGMENTATION AND PROFILING OF CUSTOMERS AND USERS

  • To analyse and segment the characteristics,personal data and purchase history of users and customers in order to obtain common profiles.
  • To enrich the profiles of customers and users with data obtained about them from other sources (interaction with JANÉ on social media, etc.).
  • To carry out marketing analysis and studies in order to design specialist products, services and promotions based on the profiles, characteristics, needs and purchase histories and trends in the sector in which JANÉ operates.

A. What is segmentation and profiling?

In order to design and send you promotions and business and advertising communication that is as personalised as possible with respect to your needs, trends, characteristics, habits, interests, purchasing history or use of the user account we use segmentation, analysis and profiling techniques in order to better know your tastes, interests and preferences. 

The segmentation and profiling are automated techniques and processes used with the aim of improving the quality of the customer and user data we have available. The application of profiling techniques to customer and user data allows us to discover and define quality requirements and rules regarding the data, and the segmentation techniques allow us to segment the customers and users based on the various requirements and rules obtained through the profiling techniques. In that way, we can identify common customer and user profiles, and can offer promotions, products, services and information which is much more personalised in accordance with their tastes, interests and preferences. 

B. What information do we collect in order to carry out this profiling?

In order to carry out the profiling we need to gather and handle the information detailed in point 3 of this privacy policy, including, your basic information (full address, name and surname(s)), your characteristics, preferences, likes, habits, information on whether you have children or not, the age of your children, products marked as interesting in your user account, purchasing history, your profiles on social media and your interaction with us through our social media profiles ( in the event that you consent to sharing this personal information with us), etc.

C. How does the profiling affect the sending of business and promotional communication via electronic means?

The profiles obtained are used in order to offer customers and users personalised promotions, products, services and business communication, in accordance with their tastes, preferences, characteristics, purchasing history and the list of products marked as interesting. Legal obligation: Regulation (EU) 2016/679 of the European Parliament and Council, of 27th April 2016, in relation to the protection of natural persons with regards to the handling of personal data and on the free movement of such data, repealing Directive 95/46/EC, obliges us to respect your rights and maintain evidence of compliance on our part with your request to exercise the right to suppression.

We will save your personal data for the legally prescribed period and, subsequently, for the prescribed period for the lodging of any claim in relation to the effective or deficient response on our part to the right to suppression or objection that you have exercised.

7. TO WHOM WILL WE PASS ON YOUR DATA?

JANÉ may pass on your personal data to companies within the same business group (JANÉ, S.A.; CONCORD 2004, S.A; BABYNURSE, S.A.; y GROUP JANÉ OUTLET, S.L.), manufacturers, distributors or any other relevant third party appropriate for the processing or handling of the purchase or delivery of your orders, complaints regarding products, enquiries regarding the availability of a product or any other request for information, consultation or request submitted to us via our contact form available on the Website, whenever necessary. 

Other possible third parties to which we may pass on your data, under legal requirement or basis that legitimises the action:

  • Legal consultants
  • Courts
  • Tax Office
  • Government bodies and public administration
  • Security forces and corps
  • Those contracted for handling who, in order to provide the necessary services, must access specific personal information and/or data. The data may be passed on to suppliers with access to data with whom the obligations and responsibilities assumed in the handling of data have been drawn up, in their capacity as Handling Supervisors. JANÉ enters into the corresponding contracts for contracting handling that provide due guarantees with respect to the handling of personal data, confidentiality and cancellation, destruction or return.

Furthermore, we may pass on your personal information in the following cases: 

  • If we or in effect all our assets are acquired by a third party, then in that case the personal data we have for our customers and users will be one of the assets transferred. Any operation of this nature will be reported and notification will be given in advance.
  • In order to protect the safety and rights of our personnel, our customers and users, and our IT systems. This includes the exchange of information with security forces and corps, or Courts, in the event of the detection of fraud, identity theft or any other illicit use, treatment or action.

JANÉ hereby notifies you that we work with third-party providers whose services are necessary for the correct appearance and usability of the Website and out IT systems, and that, in order to carry out their work, they may have access to your data. It is the case, for example, of providers that help us to improve and optimise our Website, the providers of technological services, or those providing maintenance services for our databases and IT systems. Courier and transport companies may also access customer data when necessary in order to deliver the corresponding prizes in the event of having taken part in one of our promotional activities.

9. IS YOUR DATA SAFE?

In order to ensure fair and transparent processing of your personal information, we will adopt suitable procedures which include the implementation of technical and organisational measures which take into account the possible risk and correct any inaccuracy identified in the personal data handled, in such a way that the risk of any error is minimised, handling your data in a fair safe way.

This Privacy Policy mat vary over time due to possible changes in the criteria followed at the time by the Spanish Data Protection Agency or other authorities, any legislative changes that may take place, and any jurisprudential rulings that are applicable to this policy. JANÉ thus reserves the right to modify this Privacy Policy in order to be able to adapt it to those criteria, and to any new legislation or relevant case law.
